Some important laws that affect our community.

 

 ARCHITECTURAL COMMITTEE MINUTES

Associations must keep written minutes of their architectural committee meetings. Corp.Code 8320; Civ.Code 1378(a)4  Committee meeting minutes must be made available to members upon request.
Civ.Code 1365.2(b)(1) 
Information may be redacted from records to protect privacy or privileged attorney-client communications. Applicants may attend the Design Review Committee meetings.


LOW WATER-USING PLANTS

As provided for in Civ.Code 1353.8, associations cannot prohibit or include conditions that have the effect of prohibiting the use of low water-using plants as a group.

Member Veto of Rule Change. Within 30 days of this notification, at least 5% of the members can request a special meeting to reverse the Board vote. The Board must give 10 to 90 days’ notice of a special meeting, at which a majority of a quorum can reverse the Board’s decision. The Board must notify the members of the results of this vote within 15 days. If an operating rule is reversed, it cannot be re-adopted by the Board for at least one year. However, the Board may vote on other "operating rules" covering the same subject.

RE-CONSIDERATION OF ARCHITECTURAL DISAPPROVALS

As provided for in Civil Code 1378(a)(5), if a proposed change is disapproved, the applicant is
entitled to reconsideration   by the board of directors of the association that made the decision, at an
open meeting of the board. This paragraph does not require reconsideration of a decision that is made
by the board of directors or a body that has the same membership as the board of directors, at a meeting
that satisfies the requirements of
Section 1363.05. Reconsideration by the board does not constitute
dispute resolution within the meaning of
Section 1363.820.

 Proposed Change. At least 30 days before a vote on adopting or amending an operating rule, the Board must mail a copy of the proposed change to the members, along with an explanation of their purpose and effect. After the 30-day period, the board may adopt the rules, after consideration of any comments made by association members.
Notice of Adoption. Within 15 days of voting on the rules, the Board must notify the membership of the results of the vote. Civ.Code 1357.130

Enforceability. An operating rule is enforceable if it is:

1)     in writing,


2)     within the Board's authority,


3)     consistent with governing law and the associations governing documents,


4)     adopted in good faith, and


5)
reasonable Civ.Code 1357.110
